Title Matters – State of the Association

As a part of LAILTA Membership, TITLE MATTERS is a monthly newsletter containing articles of interest to the Independent Land Title Agent in Louisiana.

This month’s installment is a letter from President Ben Luke, and information for the upcoming Spring Seminar.

LAILTA is in its 6th year of existence, and membership continues to be steady.  Last year saw membership grow to over 100 title agents, not counting non-title agent employees and associates.   Various members are active on committees and panels which review matters of interest to the title law practitioner.  We have a presence on the La Dept of Insurance Agent’s Council, LSBA’s Notary Task Force, LSBA’s Title Standards Committee, and LAILTA has maintained an active presence in matters legislative.

LAILTA has had as part of its platform from inception, the standard that Marketing Service Agreements and Affiliated Business were detrimental to the consumer and created unequal competition among title agents.  NOW, CFPB has come out and all but banned Marketing Service Agreements, and to some extent has expressed it will look closely at Affiliated Business Arrangements, as set out in the CFPB’s 2015-05 Memo from early October 2015.   This confirms one of the propositions on which LAILTA and NAILTA were formed; and have consistently been argued for 8 years now, both in the State legislature and on Capitol Hill in Washington DC.  We were right:  MSAs and AffBAs are bad for consumers, and bad for fair competition.

Oct 3 came and went and the world is still revolving, and many of us are, or will soon be, BP Compliant.  Think of TRID as the “The Reason I Dance” with the idea that our business is fun, creative and a powerful force in the American economy.  Without ‘merchantable’ title our economy grinds to a halt, for who will loan money for the plant that employs thousands who spend money in the economy, if the plant site is located on property with un-merchantable title?

LAILTA has instituted a new Membership Section for Law Students attending any Louisiana law school, we have 12 members now.  Membership is free and students are encouraged to attend our seminars.  Several students from Tulane attended the 2015 Fall Seminar in New Orleans.

LAILTA has expanded the Board to include 15 members from all corners of the state, to encourage participation, introduce them, the following are you current board members:

LAILTA is a non-profit trade association that represents the interests of independent title insurance agents and independent real estate settlement professionals from across the State of Louisiana. It was created by independent land title agents who seek to represent independent and locally owned businesses from the title insurance, abstracting, surveying, and real estate community.
